Minnesota Laws About Cell Phone Use While In A Car

Minnesota drivers can be fined for using a cell phone while driving.


Many states have laws that restrict or prohibit cell phone use while operating a motor vehicle. Minnesota is no exception. If you reside in Minnesota, or pass through, know the laws pertaining to cell phone use. Understanding Minnesota's restrictions can prevent you from being ticketed and paying fines.


Laws for Underage Drivers


Novice drivers operating with a permit or provisional license who are under the age of 18 are prohibited from talking on a cellular phone while the vehicle is in motion. There are no exceptions and it is still considered a violation even if a hands-free accessory is utilized. Minnesota also makes it illegal for teenaged drivers to text message while driving. The law defines text messaging as typing, reading or sending any type of electronic message from a wireless communications device. Teens can be pulled over if they text and drive, even while stopped in traffic. Resulting fines can be as much as $300.


Laws for Drivers 18 And Up


As of July 2010, Minnesota does not have a ban restricting adult drivers from talking on a cellular phone while driving. There is, however, a law that prohibits drivers of any age from text messaging, e-mailing or browsing the Internet from a cell phone or wireless device. Minnesota considers the law a primary offense, meaning you can be pulled over for violating it--even if you are stopped in traffic. Fines can be as much as $300.


Additional Information


The law makes exceptions for teenaged drivers in an emergency situation who utilize a cellular phone to obtain emergency assistance or report a traffic accident, hazard or a crime that is about to be committed. Employees in an authorized emergency vehicle performing official duties are exempt from the law. Additionally, school bus drivers are prohibited from either talking on a cell phone or text messaging while operating a school bus. The school bus driver laws are primary offense laws.
